Welcome to Upmega. These Terms & Conditions govern your use of our website, services, and purchases of furniture and related products within Kenya. By accessing or using our platform, you agree to be bound by these terms.
1. Definitions
- “We”, “Us”, “Our” refers to Upmega.
- “User”, “Customer” refers to any person using the platform.
- “Products” refers to furniture and related items listed for sale.
2. Eligibility
You must be at least 18 years old or accessing under supervision of a legal guardian to use this platform.
3. Product Information
We strive to ensure all product descriptions, images, and pricing are accurate. However, slight variations may occur due to lighting, wood texture, fabric, or manufacturing differences.
4. Pricing & Payments
- All prices are listed in Kenyan Shillings (KES).
- Prices are subject to change without prior notice.
- We accept M-Pesa, bank transfers, and other approved payment methods.
- Orders are processed only after full or agreed deposit payment.
5. Orders & Confirmation
Once you place an order, you will receive a confirmation via SMS, email, or WhatsApp. We reserve the right to cancel orders due to stock unavailability or pricing errors.
6. Delivery Policy
- Delivery timelines vary by location within Kenya.
- Nairobi deliveries typically take 24–72 hours.
- Upcountry deliveries may take 3–7 business days.
- Delivery charges may apply depending on distance and item size.
- Customers must ensure accessibility to delivery location.
7. Assembly & Installation
Some furniture items may require assembly. Installation services may be provided at an additional cost.
8. Returns & Refunds
- Returns are accepted within 7 days of delivery only for manufacturing defects.
- Custom-made furniture is non-refundable.
- Items must be unused and in original condition for return approval.
- Refunds (if approved) may take 7–14 business days to process.
9. Warranty
Selected furniture items come with a limited warranty covering manufacturing defects. Warranty does not cover misuse, wear and tear, or accidental damage.
10. User Responsibilities
- Provide accurate delivery details.
- Ensure availability during delivery.
- Inspect goods upon delivery before acceptance.
11. Limitation of Liability
Upmega shall not be liable for indirect, incidental, or consequential damages arising from use of our products or platform.
12. Intellectual Property
All website content, including images, branding, and design, is owned by Upmega and protected under applicable laws.
13. Privacy Policy
We collect user data solely for order processing and service improvement. Your data will not be sold or shared with third parties without consent.
14. Force Majeure
We are not responsible for delays caused by events beyond our control such as strikes, pandemics, natural disasters, or government restrictions.
15. Amendments
We reserve the right to update these Terms at any time. Continued use of the platform implies acceptance of changes.
16. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved under Kenyan jurisdiction.
